Ask Me Help Desk - DHS took my kids.then offered visitation after we were cleared

In the city of Philadelphia here in PA we have the Department of Human Services to welfare the families and there children. On Jan 1 2008 at 236 pm my daughter passed away. She had a very rare genetic disorder in which she was never diagnosed. My wife and I took her to all types of specialist and doctors, one being in the same hospital she passed away in. Her death was sudden and a shock to all of us who loved her. The same hour of my Daughter's death, DHS arrived at the hospital immediately or they may have been already there, who knows. Nevertheless, we were instructed to take them to my brother's house to check the status and condition of my 4 children that were dropped off in light of this tragedy. My father who's a Deacon at a church in Philly immediately vollunteered to take them to the house where my kids were (1, 2, 6 and 7) The DHS rep that went approved of the house and the kids were allowed to stay there. In so much pain and wanting our kids at the same time, we drove to pick them up early the next morning to prepare the oldest two of the bad news. The day went by dinner was over when the door rang and it was two DHS workers in a white van. They claimed to just want to check the obvious just to be certain for their records. I allowed them to phograph my kids, my food closets the refrigerator, my daughters room who passed away eveything that asked, I cooperated. The one worker went outside, for whatever reason. Five minutes later the philadelphia police 15 deep were at my door telling me I have to turn my children over to DHS. Of course I flipped, and eventually allowed the trustworthy philly finest to take my children, no warrant, no restaining order, no nothing! They told us they were taking the kids back to their uncles house. They never made it there! They lied to us. We were up all night just crying, uncertain of what was happining, besides, I'm morning the lost of my babygirl. The next morning, we went straight to DHS and demanded answers or the copy of the cps report, to no avail. Within 48 hours of them taking our children, The philadelphia Medical Examiner contcted DHS faster than usual due to the high media attn, and told them that there was no way possible that the parents could have done anything to harm this child(this conversation with DHS and the M.E. happened right in my living room)Still no children. The next day was court and the court became aware of the Medical examiners hearsay and said we can visit with our children for one hour per child . WHY! Of course why! Because the child advocate ubjected to hearsay and wanted to wait for the finlal report. Meanwhile my 2 year old drinks soy milk and they don't even no it. My 1 year old came home with a black eye and the oldest 2 missed 3days of school. The CPS reports claims that we starved our daighter to daeth and that she was 45 ponds 4 months ago and 15 at the time of her death. Ummm she was taken to the doctor all the time and no where in her file had she ever weighed in at 40 her entire life. She was severely mentally disable, never walke, never talked, she was 6 when she died. She died one of the hospitals that she stayed at for a week to see nuroligist, who said she wasn't having seizures but 3 may 4 years later the same doctor said she was having seizure... I don't know,, I'm sorry pleases forgive me for rambling... I just want to know if I can make these DHS, and whoever else pay me for my sickness... this has caused me to go into a deep stage of isolation and depression,, my doctor gives me meds that I must take eveday.. can some one answer.. can I sue, and will it be enough for my children and I to move away from FILTHA DELPHI

Were you charged in the death of the 6 year old?

If you are suffering from deep isolation and depression and are medicated every day DHS probably has some concerns - and perhaps the hospital where your daughter died called them in.

I don't know but at this stage you need an Attorney, not a legal advice board.

I would believe if you move at this stage child protective services in the next jurisdiction will be looking closely at you, too.

If there was no probable cause for concern, certainly you can sue. Can you collect with be the question - and this will be prolonged and messy.

Sorry maybe I was misunderstood... Prior to this situation in my life I was an everyday productive member of society with no mental disorders whatsoever. I was asking about moving away just because I grew to hate the state and city where I was raised, not because Im running. This matter with the courts was already DISMISSED WITH NO FINDINGS! And yes, my wife and I were accused of medical neglect which was supposed to be the cause of her death. We were also accused of starving her to death. They put a restraining order on us against our own children and contacted the school and told the principal that we are not allowed to pick the kids up as normal. We were kept away from our children afer their sister died for 7 agonizing days while they were being abused in foster care. I will never tell one lie about what happen during the week of Jan 1, 2008. The pain some time gets unbarable. I seem to make progress in therapy, but it makes me more sick when I think of the last day in court when everyone just kept apologizing for something that they knew was untrue for 80% of the time.

You have the right to sue and you have the right to find out just who your accuser is. A lot of lawyers will do it on percentage if you can't afford one. It sounds like you have grounds provided what your saying is true. The time to get it started is now because the papertrail is a lot easier to follow. The hardest thing in life has to be losing a child. And what they put you through after that is insane. If you were in the media etc then you have more then enough grounds for damages against them.
