    Judgement help
    I just received a civil summons two days ago about a judgement on a discover card account. I found out my husband opened the account in my name without my knowledge. I need to know what steps need to be taken to take care of this. The amount they are asking for we do not have. Is there a payment plan we can use or can this be settled? Please help this my first judgment and all other cards in my name are in good standings.

    First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

    So the summons is in your name only? Are you still married to this cheat?

    To start you need to answer the summons by sending a letter stating your intent to defend against the suit because you are not sure you obtained this card. You also request a hearing. You send a copy of that letter to the plaintiff requesting verification of the debt.

    From there depends on how badly you want to stick it to your husband. Since he committed fraud in oipening an account in someone else's name then defaulting on it, you could have him sent to jail. If that's not what you want to do, then contact the plaintiff and ask what can you do to settle this.
