    H1 holder, F2 child, can claim as dependent?
    Hi,

    I changed status on 4/1/2007 from F2 to H1, however, my child remained on F2 with my husband. I should file as a resident and my husband a non-resident. I wonder

    1. whether the child to be treated as a resident so that I can claim the him as a dependent and get child tax credit. (In this case, my husband will file separately as non-resident.)

    2. If my husband file jointly with me as resident, whether our child can join as well as resident so that we could claim the child credit.

    You have already completed SPT on H1-B. You can file a resident return as Married Filing Jointly. You can claim deduction for your child also.
