My X-husband owes a few thousand dollars in child support, can I either lien his new house that has both his name and his new wife's name(which is a different last name) or I recently found out she deposited an inheritance in their joint account, can I freeze those assets and collect?

My X husband owes me a few thousand dollars in back child support, can I lien his new house that has both his name and his new wife's name (her current previous last name that is different then his) and or also I know she has received an inheritance and deposited it their joint checking account, can I freeze thos assets,if there is no proof it was actual inheritance and just a cashiers check?

Do you have a Judgment for the past support? If not, you cannot do anything.

If you do you can lien against his property (even if it's held jointly) - real estate, checking accounts, anything.

Once her inheritance is co-mingled with other funds it can be seized - somebody else just asked this. The Court is not going to sort through the deposits and withdrawals and decide just what deposit was used for just what expense.

You will have to go to a judge and explain to him about the child support arrears and how hubby has a new house but can't afford to pay child support and the Judge will happily order him to pay up pronto. Get an attorney or go to Child Support Enforcement and they can help you collect from this deadbeat dad.
