The father of my son is an illegal mexican imagrant... if I give my son his last name can he take him and I not be able to do anything, and does that make my son illgal as well?

If I give my son his illegal fathers last name... what are the standards of that?

If you are a citizen and you gave birth then no your son is not illegal.

1. If both you and your husband are illegal and the child is born in the US, the child is still a US citizen

2. if one of you is a US citizen, then the child is a US citizen

3. The child's name has nothing to do with it at all

Does he know the baby is his? Is he saying he will take the baby?
Are you broke up with him? Does he plan on being at the hospital when you have the baby?
