    Fiancé would like to adopt my son
    My son is 8 years old and has never met his biological father who has no interest in even seeing his son or paying child support.. my fiancé now has been taking care of my son for 5 years now and he knows my fiancé as dad and nothing more or less... my fiancé really wants to adopt my son but I don't know how that would work or how I would have to go about it , considering I'd have to get his biological dad to sign over his rights, so if anyone knows how I have to go about this legally, please help me.

    Is his biological fathers name on the birth certificate because if not you can say you don't know anything and they will place an add the paper for so many days if he doesn't step up then your fiancé would be good to adopt or you could just get a laywer which is a long expensive route

    Consult with an attorney. You will have to get one anyway if your fiancé is going to adopt your son.

    1. Get married. Most states won't let a mere fiancé adopt, but they WILL let a husband.
    2. Attempt to contact the birth father.
    3. Go after child support.
    4. Get an attorney.
    5. Make a deal with bio father that if he signs over his rights, you'll drop the back child support.
    6. Go to court and have bio father's parental rights signed over and adoptive father's adoption papers signed.

    Don't forget to consult with an attorney to make sure that you are doing everything that you need to do within the state that you live in. Definitely get married first. Synnen is absolutely right. I would venture to say that ALL states would not allow anyone but a spouse to adopt the other person's child. The child support thing is a fantastic bargaining tool, as men for the most part do not like parting with their precious money even though it is for THEIR child. They view that this money is going to their ex and not their child, which is sad. Good luck to you and your future husband!!
