For applying ITIN for my wife
    Hi,

I am in U.S now with expired H1 visa (with I94 extension). I lived with my wife in U.S in 2007, and she left to india in nov 2007 and she is in india now and also her visa got expired.

    1. My wife is not in U.S now and her H4 visa also expired and she doenot have a SSN.
So for applying jointly I need an ITIN for my wife. Is is possible to apply for ITIN for my wife?

    2. Can I filing jointly for year 2007, I will be losing more amount, if I file individually..

Please let me know... What si the possible solution??

    1) Yes, as long as her PASSPORT is not expired.

    2) Yes, you can file jointly, Your wife's physical is irrelevent; she could be on Mars for all the IRS cares.
