I have stayed in U.S.A for about 4 months between Aug 2007 to Dec 2007. Even my wife was with me for nearly 1 month and than we returned to India.

Now For Tax Filling can I put my status as Married and claim the benefit. I do have an SSN but my wife does not have ITIN.

Is their any critiera for claiming my wife in Tax like number of days she spend in USA?

If you were in the U.S. from Aug 2007 to Dec 2007 as nonresident, you will file a nonresident tax return. You won't get exemption for your wife.
