    Violating probation in Virginia
    Husband gets second offense DWI. Is put on probation. Probation period ends soon... in the meantime he gets a drunk in public - 4 months before probation end date in same county where DWI occurred. I am assuming this is a violation of his probation and he'll now be sent to serve the remainder of his sentence that was once suspended or is this at the judges discretion? What can I expect to happen? He will be enrolling in an alcohol treatment program for himself. Clearly, he has a problem.:(

    Clearly he has a problem, and having lost a love one to a drunk driver, I have believe the laws on this crime need to be much harder. ( sorry)
    But it is just up to the probation officer first and if he revolks the probation, up to the judge as to how to determine the punishment will be.

    The judge won't be too happy with your husband and he will decide what to sentence him if the probation department violates your husband (which they will). Enrolling in the program is a good idea but he will have to actually attend to make it count.

    I will go on to this, most of our jails are full, and the few areas that have probation and parole detention centers often find them full also. So often while a judge wants to send certain people to jail for violation of probation, often if there is no harm to another, no weapon used, then basically they are given too may chances.

    It is possible that the judge will demand some treatment program
