The middle stem needs repairing or replacement. Home depot carries a repair kit for the diverter. Most do not give a positive seal though, even new

So if I buy the kit for the diverter the water will stop coming out of the spout and the full pressure will go to the shower head?

I am having a major problem in taking off the handle of the diverter it seems as if it is welded on.

I am I doing something wrong? I need this fixed before my Mother-in-Law comes home tomorrow. God this stinks!

At home supply purchase a faucet handle puller and a seat wrench. Remove center handle, remove stem, remove seat. Purchase new stem and seat. Take old seat with you to match up to new one. If the shoulders of the stem are recessed into the wall you may need to purchase a tub faucet wrench to remove. Looks like a big cheap socket (cause that's what it is).
