Resident Aline on F-1 VISA (treaty benefits and exemptions)
    Hi,

I am/was a student on F-1 VISA from INDIA for the whole year of 2007. I have been in the US for more than 5 years and hence for tax filing my status in that of a Resident Alien. I have a few questions regarding this situation:

    1. Which form do I fill for federal taxes, 1040NREZ or 1040 or anything else?

    2. As a resident there is a certain amount of exemption. However, as a non-resident alien on F-1 VISA I have been using the Article 21(1) to get certain exemptions for the past 4 years of tax filing. For the tax filing of 2007, can I use both of these exemptions, namely the 21(1) exemptions for F-1 Students from INDIA and the exemptions for resident status? Thus what will be the total amount of exemptions?

    3. Also do you know the exemption amounts for 21(1) for 2007.

    Thanks,
    Abhishek.

    1) Forms 1040, 1040A or 1040EZ.

    2) Negative; the treaty exemption NO LONGER APPLY!

    3) Irrelevant, since you cannot claim them.
