    Can I request a new attorney for my child
    My sister has gardiansip of my daughter. The child's lawyer has beed rude and does not want to work with us. He has told my sister that he does not want us to have her back. Is there any way we can request an new lawyer for the child.

    Your sister, as her guardian, would have to be the one to request a new attorney for the child. Of course, you always have the option of hiring your own attorney for yourself, especially if you want to fight to try and get your daughter back.

    Hello Barb:

    Sure you can request it. However, the child's lawyer is representing the child's interests - not yours. He doesn't have to be nice and he doesn't have to work with you.

    If it's his opinion that the child will be better off NOT living with you, no judge is going to fire him because you disagree. He's not supposed to AGREE with you.

    Have you asked him why, the child's attorney is working normaly though the courts for the child's best interest. Your sister who is guardian, may have a legal right to request on, but since at this time you have no rights to the child, I see no legal standing for you to request it.

    You do need to hire your own attorney to prove your case. Or find if the attorney has a list of requirements YOU must meet to get the children back
