    Restitution as Condition of Probation
    I just got a CC of a letter sent to the DA by my probation officer requesting help determining restitution. It was regarding hospital/drug testing fees. I believe they are referring to when I had blood drawn for a DUI.

    Anyway, I've been on probation for 2 years already and this happened about 5 years ago. Isn't it ridiculous to be doing this now? I mean if someone really wanted some money out of me they would have tried to get it by now right? Oh well I guess its her job.

    It's a condition of my probation to pay restitution in an amount to be determined by my PO. Anyone have any experience with this?

    Would sound more like a fee for any drug testing that the PO may be doing or have done, or some set fee probation charges for these tests.

    Why not ask the PO what they are for,

    Never heard of anything like that before but nothing surprises me anymore. My guess is the hospital is just trying to get more money and you happen to be it for right now. If it's not some outrageous amount I'd just pay it and forget it. You could be stirring up a hornet's nest if you question the higher ups. I do find it odd also that they waited 5 years to "bill" you for this and in that kind of manner. If you wish, I would suggest asking a Probation supervisor about this. There may have been a new local law passed which allows the hospital to pass along the costs now in your area and they're just going along with the program. The fact that the letter was sent to the DA it is probably like I said, some local law recently passed, etc.

    Let me clarify a little... At my sentencing hearing, back in 2006, the judge ordered restitution. He didn't give an amount, it was up to the PO figure that out.

    I spoke to her like a month ago [shes a new agent, just got my case] about restitution and told her I've never been asked to pay any. She said she didn't have anything on file from anyone requesting restitution also.

    So, why she would go and stir up an old issue is beyond me.

    Showing her boss she is on top of the job, new PO often go out of their way to prove how good they are, you got the "lucky" draw.
