    Filing US taxes from India?
    Hello friends,

    I have query related to filing US taxes from India. I was living in the US on F1 visa until July 2007. From June 1st 2006-may 31st 2007 I worked on OPT (OPT expired May 31st 2007). I duly filed my 2006 taxes while living there. I only worked for 5 months in the US in 2007 and then moved back to India.
    My q's are?

    - What form should I use to file my US taxes for 2007 - 1040NR or 1040 NR-EZ?
    - Since I worked for less than 180 days (but stayed for close to 7 months), am I eligible for
    Withhold fed tax amount refund?

    1. You were on F1 so you will file nonresident tax retrun. You will file 1040NR or 1040NR-EZ depends upon your filing requirement.

    2. You will get refund only if your withholding is more than your federal tax.

    My follow query is. Isn't there a clause which says if you worked for five or less months no fed tax is charged? Or is it related to duration of stay there?

    No. If your income is more than $3,400 you must file your tax return. Since you are from India your deductions are $8,750. If you made less than this amount, you will get all your federal tax back, but you must file.
