    Small claims
    I owe a few small loan companies, nothing over 250.00.. Can they garnish or am I liable for these debts since Im on social security disability?

    I started receiving my social security disability five months ago. Since that time I owe two small loan companies. Neither one exceeds $250.00. I haven't been able to pay them, can they garnish my social security check & am I liable if I'm unable to pay them?

    No, your SS check is exempt but any other funds in your bank account(s) are not.

    Whether you can pay or not does not remove your obligation to pay. But SS disability payments are exempt from garnishment for unsecured debt. They would have to sue you and obtain a judgement before they can attach any assets.

    If you are having your payments direct deposited you should keep them as the sole deposits to that account. Then , if they obtain a judgement, inform your bank that the account only gets deposits from exempt sources so can't be attached.
