    Section 8 tenant won't move
    Hello there!

    I have been a landlord in Pennsylvania for a few years and am coming into a problem with my Section 8 tenant not wanting to move - they have been there for 3+ years. I have given them an 8 month notice which is to end on April 1, 2008, and have yet to hear anyone calling for a reference - only 3 weeks to go. Could you please let me know what steps I need to take to make them move?

    First, why do you want them out?

    In NY its almost impossible to evict a tenant when the tenant is paying his/her rent and/or not violating the lease agreement. I have heard of cases landlords actually paying tenants to move, finding them apartments and paying the security deposit and moving cost.

    Have you tried politely asking?

    IF you have given them proper notice, if they do not move, you file for a eviction in housing court and show proof of why they are in violation.
    Again some areas it is easier to evict than others.
