My apartment complex towed my truck twice in 48 hours for not having a parking permit. I had to pay to get it out the first time as I was getting on a flight to Atlanta that afternoon and I wasn't going to leave it with the tow company for a week. It was a Saturday so there was no management at my complex. Upon arriving in Atlanta that night my roommate called me later to tell me my truck was gone again. I ended up flying back on Tuesday to take care of it. When I got back I explained to them that I was never informed of a parking policy, nor was I provided a parking permit. They agreed, issued me two permits (one for my girlfriend, I guess they "felt bad") and had the tow company release my truck without charge. In my eyes they've admitted they were at fault for the towings by getting it out the second time, but they refuse to reimburse me for the first. Do I have grounds to sue for the cost of the first tow?

If you were not aware of the policy, sure, take them to Small Claims Court and let a Judge decide.

It was towed for the same reason both times, no parking permit.

Yes I would get reimbursed for this, you were not aware of it so take them to court!!

Right, I get that - but why did you think it was towed the first time at that time?

I would think they would reimburse you for the first tow (when you didn't know the policy) and not the second.

I had no idea. I was unaware that they required parking permits, and I was sure I parked it fine. It wasn't in a handicap spot or anything like that.

I didn't find out about the policy until after the second tow. It was towed early Sat. morning. Management wasn't there, and the girl working couldn't even find the tow slip. Fearing a massive bill for leaving it in tow for a week I had to get it out before I got on the plane. It was towed again late Sat. night. When I finally reached management on Monday they she told me she could have it released, but of course I had to get it in person. I didn't trust that they would reimburse me if I waited the rest of the week so I flew home Tuesday to get it. After getting it out I asked the manager about reimbursment for the first tow and I was told "She'd have to check with her supervisor". A few days later I knew nothing would be resolved through them.

I think I will go forward, but I'm defininitely going to wait until I move. These seem like the type of people to retaliate. Statute of limitations on this sort of thing has to be at least a year right?
