    F1->OPT->H1B Tax status
    I realize this topic may have been beaten to death but I am hoping someone would be kind enough to help me out.

    I have been on F1 since April 2001 and received my OPT on June 2006, I worked on my OPT till June 2007 and received my H1B starting Oct. 2007.

    I would be grateful if someone could please let me know
    1- What is my residency status
    2- Which form would I use 1040NR just the 1040.
    3- Could I claim the exemption from the tax treaty with India, (Indian citizen)

    1) You are a resident alien for 2006 and 2007.

    2) Use Form 1040 for BOTH years.

    3) No, but as a resident alien, you can claim the standard deduction.
