    Hi Tax Experts,

    I came to the US in 2002 on F1. Changed to H1b in 2006. Since 2007 is the first year that I am going to file tax as a resident alien, I have some questions. Your help is greatly appreciated!

    1) Do I still have to file form 8843, which I have always filed for the past 5 years?
    2) Can I still claim the US-China tax treaty benefit? I work in IT field for a non-profit organization.
    3) I married a US citizen in 2007. We plan to file separately for 2007. How will the marital status change affect my tax return? Do we get more tax return by filing jointly in the future?
    4) Should I file form 1040, 1040A or 1040EZ? I only have wages from my H1b work. I do not have any dependents. I do have some dental expenses ($5,500) that was not covered by my dental insurance.
    5) I heard that Nonresident Aliens are not eligible for the $600 tax rebate. Since I am a resident alien for tax purposes in 2007, am I eligible to receive the rebate?

    1) No.

    2) Yes.

    3) You will have to file Married Filing Separately.

    4) Try Form 1040 wth a Schedule A. the combination of your medical costs and the withheld state income taxes probably will allow you to itemize.

    5) You WILL be eligible for the stimulus rebate.
