What is the eligiblity for a stimulus payment
    Hi,

I am on H1 with a SSN my spouse is on H4 with ETIN. I have 2 kids with SSN's.
Can you please let me know who all are eligible for the stimulus payment and how much?

    Thanks

You would be eligible for $1,800, as long as you made at least $3000 and not more than $150K in 2007 (assuming you filed as married filing jointly), and you are considered resident aliens for 2007.

As far my knowledge, since your wife doesn't have SSN - you are not eligible for stimulus payment.

As far my knowledge, since your wife doesn't have SSN - you are not eligible for stimulus payment (if you file married filing jointly).

If you file married filing separately, you will be getting 1200$

That's correct - according to the IRS web site Basic Information on the Stimulus Payments

Taxpayers with an Individual Taxpayer Identification Number (ITIN) instead of an SSN are not eligible to receive a stimulus payment. Both people listed on a "married filing jointly" return must have valid SSNs to qualify for the payment — if only one has a valid SSN, neither can receive the payment.

Sorry for the misinformation in my earlier response.
