I have twins who are almost two years old. I am not 100% sure that their father is the man I think he is. We are going to do a DNA test so that my fiancé can adopt my children. Because of the money situation, we are thinking about doing an at home DNA test. Since it is not legal binding, would that make it easier for my fiancé to adopt my children or harder? We live in Taiwan but I am from Arizona and my fiancé is from Indiana. The kids' birth father has not been in their lives for the past 2 years. He is an alcoholic and was in prison before they were born until they were 16 months old. He hasn't paid any child support because he doesn't think he's the dad. Does anyone have any advice on how to get my fiancé to adopt my children? Time is of the essence. In order for my children to live here with a alien green card, my fiancé has to adopt them. We are getting married this July 12th and were hoping to get the adoption process started ASAP but we don't know what the first step is. Please help!

Wow... with that many states and places involved, I'd get a lawyer. I recommend a lawyer in any case, but in this case it may be doubly important.

A home DNA test is not going to be legally binding.

To get one that would be court ordered would be preferable--I suggest you file for child support through the courts. Then, the onus of proving (lack of) paternity is on the man you think is the bio father.

Then, too, you'll have a bargaining chip--if he signs away his rights so that your fiancée can adopt (and depending on where you are, you may need to be married before he can adopt), then you can drop the past child support charges.

However, laws vary from state to state, and I have NO idea what laws in Taiwan are. Your best bet is to get a lawyer that is versed in adoption/family law.

A home DNA test is going to be a waste of your time and money. Since it is not reconsied, you will just have to do a new test though an approved lab. So what you will need is an attorney to get the bio father servied, prove he is the father, have him sign over his rights and go ahead with the adoption.
