My boyfriend won't move out... My Mother owns the house, and we live in one of the apartments... he has been telling me that she cannot evict him without evicting me also... which doesn't make much sense to me at all! There is no lease, we pay month to month (since I'm family and all). So what I'm asking is what kind of notice does she have to give him, and he does have to leave right?? Please Help! Thanks!

He is saying whatever he thinks you will fall for and hoping you accept it as fact.
Your mom has to go to district court/magistrate and file for an eviction notice.
Then he has whatever amount of days left to work on moving out. I have heard two weeks to 30 days. My neighbor just got 30 day notice but I think it depends on the law in your area.
And N0 you would not be kicked out along with him!

Yes, she can give him notice, if you pay monthly normally a month notice, now he can ignore it, then your mom will have to file in housing court for a formal eviction though the court.
