    Late police report
    I had an accident.It was clearly other guy's mistake.However I didn't have the police report although the police was at the scene.I claimed at the other guy's insurance and after 1 month the insurance says my claim is denied because of not having police report.The insurance company says they'll make my car only if I get a police report.If I dunt they are threatening to sue me.Is it too late to get a police report?it's been 1 month since the accident happened.

    Go get the police report and resubmit your claim to the insurance. If you have insurance, let your insurance provider deal with them. A lot of insurance companies will do anything they can to stall or get out of paying.

    Isn't it too late to get the police report.

    First that is a lie, they don't need a police report, in many areas for example the police will not do reports done on private property, and for minor accidents there is no requireemnt by law to call the police.

    So they are using this as an excuse, expect them to have another reason to deny after you get a report. Depending on the amount of claim, I would sue the other driver in court, when you win, they will have to pay.

    Now for the police reports, some departments will allow you to file a report but it won't be any good really, all it will say is that you came in and reported this or that, \\
    It will not have the police report what they say, what the officers believed was the cause, and what damages they viewed. It will not contain the officers drawing of the accident.

    Now the police may have wrote up an incident report, anytime we went on any call, we had to do a index size card that said what we did.
    I will say many departments will not do a report after the fact.

    A police report is definitely not required for an insurance claim settlement. It is a helpful tool when arguing liability. However, unless the driver who caused the accident admits it & then gives a written statement at the scene, then it may not resolve the liabiity issues.

    You said that the poice were at the scene. Did they take your info & the other driver's info? If they did, then there was probably a report made, & you can get a copy of it based on the local procedures. If they didn't take the info, then there may be a problem getting them to make a report 1 month later.

    NOw I got the police repoet saying I was bit in speed but the other guy had to yield.
    The insurance again denied saying I was also responsble for the accident.

    Get three estimates and sue the driver in small claims court. It's quick, cheap and easy.

    What state did this occur in? Some states go by what is known as contributory negligence, & others comparative. If it is contributory, then it could depend on the percentage each party contributes to the cause of the accident; some states if it even 1% then you are not entitled to any settlement. Comparative usually if one person is 50% at fault then they will pay the other 50% & so on.

    Once this is resolved I would change insurance companies. The one you currently have looks like they will only pay if forced to. So you may have to sue them as well.
