    My fiancé wants to adopt my 2 children, but.
    My fiancé wants to adopt my 2 children, but they get child support from a father who wants nothing to do with them. I think there father lives in Nevada living a whole new life children free. He hasn't seen or spoken to my kids in over 5 years, my daughter (5yrs. Old) doesn't know him and my son (6yrs. Old) knows who he is but doesn't remember him. Now I couldn't care less for the child support if it ends because of the adoption then it is better on the both of us, because even though he wants nothing to do with them he does make an effort to e-mail me twice a year to complain that he wants a life where he doesn't have to pay child support. He says he wants me to send him forms so like that he can give up his rights and not have to pay child support anymore. So what do I do? Do I ask him for his address and get the forms for him to give up his rights and then do the adoption or can I try to do the adoption with the situation?? :confused: :confused:

    First, have the wedding. Most states prefer and some require that you be married before adoption.

    The bio father cannot give up his rights unless its to make way for an adoption.

    You should consult with a Family attorney as to the requirements for adoption, Once you know what you have to do, you can write the bio father and tell him that you are remarrying and your new husband wants to adopt the kids. As soon as you legally can you will be processing the adoption. Let him know that once the adoption is approved, his responsibility for child support ends. Advise him that he will need to sign papers relinquishing his rights and as soon as you can send them you will, just let you know where.

    The father can not give up his rights and stop paying child support unless it is connected with the adoption.

    So you will need to get an attorney and file for adoption, then your attorney will contact him to sign the papers.

    But again, depending on the state, some want you to be married, others will want you to be married for at least a year..

    So you will need to talk to a family attorney in your area for your states requirement
