    Salary versus wages
    If we paid employees salary and now they are claiming that they did not get overtime with the labor board. Even at wages they got more than minum wage in accordance with our state law requirements. What do I need to express to the labor board:confused:

    You need to see if you paid them not over min wage, but over the min required to be on salary, there are federal and normally state laws as to min salary that has to be paid, if you are not paying overtime.

    This amount is much more than min wage. A weekly salary of 455 must be paid to be exempt from overtime by federal law, ( your state may require a higher wage) so if you were not paying your salary employees at least 455 a week on their salary, you will owe them overtime.
