Engaged to someone who's not her father
I'm engaged to my fiancé who isn't the biological father of my 18 month old daughter. Her biological father is in prison for 33 years for 2 counts of sexual assault of a child under 13. My fiancé wants to adopt my daughter. I'm also planning to move out of state. Is there anyway I can terminate his parental rights since he is in prison for the sexual assault, doesn't have custody of her, can't see her until she's 18, or doesn't pay any child support. Does he even have parental rights even though he's on her birth certificate.

( I am no expert in this)

I think he doesn't have any rights because he is in jail for 33 years, so in a way it would be impossible for him to take care of her or support her since he will be in prision...

    But then again.
    I might be wrong.

Merely going to jail does not take away rights, since as soon as they get out, they have rights to visit and so on. He could get paroled or even appeal his case and have it over turned ( not likely but anything is possible)

But it should be easy to get his rights taken away by the courts.
