My sister was paid to move in with my dad and take care of him, after about a year dad passed away. It has been nine months and she refuses to vacate the house. I am the executor of the estate and am responsible for getting the house ready for sale. But I refuse to make the needed repairs until she is out because she has 4 large dogs, one medium dog, and one small dog and eight cats living with her in the house. They have ruined the carpet and the house smells like wet dog and cat pee. They are allowed to go on the carpet and have free rein of the entire house. She has the money to move out but refuses to. She also has two sons that have offered for her to stay with them until she decides what she wants to do. It is not like she has no other option. She has only started looking for a place in the last month, and I have been asking her to move out since July. She also refuses to pay rent. She just started paying the utilities about three months ago after I refused to pay them any longer. She is one of the four hairs to the estate. My question is, can I have her evicted, and if not, what can I do? We live in Texas.

I don't know but I sure hope you can. I'm glad you finally stopped paying the utilities. Maybe she will freeze herself out. What ever you do, don't lend her money for anything. I bet this has been her pattern her entire life. Yes?? I also do not know anything about executors but isn't a lawyer of a judge involved some how? If so, ask him/her. Also, when you split the proceeds make sure you consider any money you may have spent to fix the place up if she has trashed it. Deduct it from her share. Sounds like she is a "taker." That she has a sense of entitlement. I know the type. She is just taking advantage for the rent free living.

Yes you can have her evicted. You have to go through the formal process that is appropriate for your area.
