Good day to everyone! Me and husband have a problem to his ex-wife. 2 years ago we paid off the house and he is divorced to his ex-wife 7 years ago. We plan to pay his ex wife part of the house so she will not make trouble or problem with us anymore. In their Final Decree of Divorce: She is willing to quit claim as long as my husband will going to make a payment and pay her part.

My question is: Is she entitled to the whole amount of the house or she is just only entitle to the equity during their marriage.

It is difficult to analyze without knowing how the property is titled (in whose names) and knowing the language in the divorce decree (property settlement). Did your husband or his ex have a lawyer?

The house title is in my husband name and his ex-wife. On the Property settlement it say's that they both own the house. But during their divorce my husband still owe the house and his the one who make payment every month.

The property should be valued as of the date of divorce. The ex is then entitled to one half that value.
