    H1B tax form
January 2005, my H1B was approved and worked for 8 month. Thereafter, I got displaced due to hurricane Katrina and relocated. I transferred my H1B to new employer in a different state. Worked for new employer for 2 month. I've been residing in the US since July 2001. Traveled out of the us twice, 2 weeks in 2001 and 2 weeks in 2004.

    1) What tax form do I use? (when I was under F1 visa I used 1040NR)

I claimed 0 for the first 8 month with original employer in New Orleans, and the last 2 month with new employer I claimed exempt status due to a financial difficulties caused by the hurricane and no federal income tax were withheld.

    2) Do I need to do/file anything special for this?

Thank you very much for your attention, comments, and advice.

    Khsco95:

    1) You qualify as a resident alien under the Substantial Presence Test, so you should file Form 1040/1040A/1040EZ.

    2) As long as you are at least close to covering your tax liability with what was withheld in the first 8 months, you have nothing to worry about. No special forms or procedures are required.

    Forms
    Thank you very much.
In your reply you mentioned 3 different forms. Can I choose any of these 3?

There are different criteria for each form.

If you are by yourself or you are married with no children and only earn money on a job which issues a W-2, thenForm 1040EZ can be used.

If you have children, you must file at least a Form 1040A.

If you itemize or have a business or get paid using Form 1099-MISC, then you must file Form 1040.
