    Survey markers
We live in South Carolina and had our property for our driveway surveyed and marked by a surveyor. If the neighbor moves the markers or takes them up what can I do to prevent him from doing this again. Is it illegal to remove a survey marker?

    Hello Betty:

Yes it's illegal. It's your property, and he can't take it. However, I doubt the cops'll arrest him for it. So, you need to protect yourself civilly.

However, there's more to this story. Is he removing it just because it's a stick? Or is he removing it because there is a property line dispute? If there's a dispute, we need to know what that dispute is.

However, if he's just throwing away sticks, that's a different matter. Write him a letter instructing him not to remove your property again or you will file a lawsuit against him. Send your letter certified, return receipt requested. Send another copy by regular mail.

I'll bet he'll leave your sticks alone.
