My mums forced me out and now gone on holiday where do I stand?
This is rather complex so I'll try my best to explain. My mum and dad got divorced a fair few years ago... yet the martial home has not been sold and up until about 6 months ago both my mum and dad were living in the same house but were living separate lives.

Six months ago an argument issued between my mum and dad due to an incident which had occurred my mum called the police claiming assault and had an injuction put out against my dad. Over the past six months my mum has avoided going to court, furthermore my mum has changed the locks on the martial home so I no longer have keys to my house.

Last weekend she threw me out as her boyfriend was coming to stay and we had a confrontation. So when I came to collect my belongings for college she refused to allow me into the house and the police had to be called so I could get access and avoid disturbing the peace.

Finally I found that my mum has gone on holiday until the 21st I have no access to my home and need to get clothing and other belongings so my question is where do I stand legally, if I forced entry into the house could I be proscuted? Furthermore I am only 16 so is she breaking the law kicking me out as I am only a minor?

    Thanks.

Where is your dad at now ? He needs to file charges on her for abandonment if your only 16. Also if you have proof you live there like mail addressed to you or I.D. saying you do then you may be able to force your way in with a police officer present. You must clearly state which items your want from the residence and only take those items. Good Luck
