    Need a clear title
    I was issued a 1099c by my mortgage company last year and I filed it with the IRS and did everything I was supposed to. How do I get the mortgage company to give me a release of deed to clear the title? The reason I was issued a 1099c was because the property was distroyed so it is no longer worth the amount of the mortgage, they refused to sign a proof of loss and would not work with me on restructuring the loan and refused to forclose.. its a long story but meanwhile the taxes are due for 2 years and I do not want topay them if they do not release the title to me. I still have an interst in the property and want it,I am in court with the insurance co now. Since they have forgiven the remainder of the loan and filed with the IRS and I have paid my taxes do they not have to release the title?:confused:

    Hello Tuesday:

    I don't know if anybody could answer that with certainty - not with the limited information you provided.

    I'll just say this: I don't know what the insurance company is supposed to do, and I don't know how the IRS is dealing with this, but if you don't have a lawyer, you're going to lose. It doesn't matter whether you're right or wrong.

    This is clearly a complex situation. I think you will need to sue the mortgage holder to release the title. So I would get an attorney ASAP.
