F1-Opt and changed to H1B, married
    Hi,

I am really confused about my dual status Federal tax filing for the year 2007.

    My situation is:
    1. I was in F1 status from 1/1/2007 to 07/15/2007 and was in H1B status after 07/15/2007. I was married in the whole 2007. My husband is on F1 status.
    2. I am holding H1B status in the U.S for over 165days.
    3. I got only one W2 form with all the income shown.
Which forms I need to file my Income tax return. Can you please suggest me about the situation.
    Thanks
    I will appreciate your reply.
    Sincerely,
    Simi

    Simi:

You are NOT required to file dual-staus; you CAN file as a non-resident alien because you have NOT met the 183-day Substantial Presence Test.

Recommend you file as a non-resident alien, because, most of the time, filing dual-status offers NO tax advantage.
