    Contract For Deed
    My brother has a house that is contract for Deed to this one guy. The guy bought (contract for deed) the house over the summer and then took a one-week vacation during a February (cold month in MN). Either he did not turn on the heat or turn on the heat too low and when he came back, the floor is a all bended up. Now, he threaten to sue my brother if my brother doesn't fix the house. He claimed that my brother sold him a bad house.

    My brother told him that the house belong to him (they guy that contract the house) and he should fix it himself.

    With little knowledge about real estate, who is right? Is my brother suppose to fix it for that guy or the guy suppose to to fix it?

    If your brother can prove the problem was caused by letting the pipes freeze, then the buyer is at fault. Otherwise your brother owns the house until the contract is completed. The contract should specify whose responsibility repairs are.
