    Am I a resident or non-resident alien for 2007 tax return?
    Hi,

    I was a Software Engineer in California from April 2000 to May 2007 on H1B visa. I returned to India for good in May 2007 and living in India now.
    I was with my family (Wife and 2 kids) in California. I don't have a green card.
    I appreciate if you could let me know whether I will be considered as a resident alien or non-resident alien for tax filing for the year 2007.

    Also, if I am considered as a resident alien, do I need to show my earnings in India (after May 2007) in US tax filing?

    For 2007, you are a dual-status alien, which means you must file Form 1040 and Form 1040NR.

    You will show and pay taxes on your 2007 earning while in the U.S. You do NOT show your 2007 India-sourced earnings.
