I am nine months pregnant and going through a divorce. My soon to be ex-husband wanted nothing to do with the baby and kicked me out of our apartment when I was six months pregnant. Now that I am ready to have the baby he has changed his mind and wants to be called when I go into labor. Do I have to contact him when I go into labor and if I don't could this affect anything in a child custody battle?

Now that I am ready to have the baby he has changed his mind. He wants to be called when I go into labor. Do I have to call him when I go into labor? If I don't could this hurt me later in a child custody battle?
I get the impression that he wants to be notified of the labor as in most instances a divorce cannot be finalized unless the child is born. It is up to you if you want to notify him or not. This will not affect you one way or another regarding child custody.

From The Looks Of Things, U Already Know What Kind Of Father Figure Your Ex Is Going To Be So U Need To Get The Restraining Order Papers Ready For You And Your Baby Because He Definitely Don't Need To Come Within 10 Feet Of You And Your Baby. Your Baby Need Positive And Violence Free Environments.
I would not call him, there is no requirement to call him. He can not force you to put his name on the birth certificate either unless you want it there.
Why can't a divorce be finalized until the baby is born?
Maybe he wants to be there and get the DNA testing done (if that is a concern of his). No, you are not obligated to call him. The hospital can call him after you have delivered and have rested. If you want them to.

I don't think you have to contact him when you go into labor, but you do need to inform him of the baby's birth. If you don't do that it could be used against you in a custody hearing.
It might help if you explain more about the background here. Have you been through divorce proceedings? Is there a legal separation? Why did he kick you out? etc.
In a lot of states regardless of who the father is; a child born in marriage is considered the responsibility of the married couple. So even if he isn't the father he may end up with child support etc because he is the " assumed " father by marriage.Quote:

No, you don't have to contact him; but it would be a courtesy to let him know when your baby is born and the baby's condition, as well as yours. You are entitled to your feelings about your husband, but try to be cheerful about this blessing in your life and that you may need to work with him for at least the next eighteen years for the benefit of your baby.
I am going threw legal proceedings and believe it or not I'm a amazing father who works hard. My sons mother is just a bit out there, and I loose at every turn
