    Filing US Tax from India
    HI,

    I was working in USA (Virgina State) from Nov 2004 to Dec2007 and filed my returns till last year. I travelled back to India on 28th Dec 2007 and was paid a part of my last week salary for Dec07 in Jan08 and now got my W2 form for the same. As I did not stay any day in Jan 08 how can I file my tax return. Can I do it online for both Federal and State tax.

    Please suggest me with your views on filing the Tax return.

    You can mail the tax return.

    Employer will not give you W2 for income in 2008. You will get it only in Jan 2009.

    Also you don't need to file tax return if your income is below the filing limit. For 2007 return, this is $3,400 for nonresident and $8,750 for resident Single status.

    HI,

    I mentioned the years wrongly. I worked till Dec 2006 and travelled back to India on 28 Dec 2006 and was paid for the last week pay in Jan 2007 for which I got my W2 form now. I wages before tax deductions are around $ 5700 (federal tax $1000 and State tax $300).

    Pl let me know if I can file the tax return online (should I choose no reseident for State tax). Will I get any refund on my taxes.

    You have not provided information about your visa, which return did you file in 2006, so I can only provide general information.

    Only resident tax return can be filed online (both for state and federal). Federal Nonresident return can't be filed online, while you can file state return online.

    For a resident, the standard deduction is $5,350 and exemption is $3,400, which means your income if below the filing requirement as resident. You will only file to get the refund of the taxes withheld.
