I want my deposit back from my apartment
Ok so I live in a run down apartment and my landlord is totally slack. My lease is currently over and I'm just month to month because even though she said she was going to bring me a new lease to sign and she never did.

I moved in under extreme circumstances (my house burned down) and needed something. She didn't shampoo the carpets or paint and that was OK because she waived my pet deposit. I painted myself and upon cleaning realized the apartment was totally stained and disgusting. She also promised to fix a hole in my ceiling and she never did and now with all these storms WATER IS COMING INTO MY APARTMENT!! On top of that she contacted me months ago to tell me that my bathroom was breaking code because there wasn't a window or ventilation in there and that she would fix it, surprise she still hasn't.

Ok so I know that I should have stood up forever ago but how do I move out and still get my deposit back?

Did you keep your copy of your lease? If yes, see as to what your lease contract says about your deposits. Do you have records of your request for repairs and complaints about the condition of your apartment address to your landlord? I hope you do. Because if you don't it will affect your deposit considering your rented unit needs works.

Did your landlord told you that you are now on a month-to-month rent? If yes, you can write your landlord a notice that you want to move-out. Let him know within 30 days since you are now on a month-to-month. Make sure he receives your notice. Then and only then you can legally without obligation move-out, provided you would leave the rented unit the same condition by the time you first move-in.

Edge is right - if your lease is month to month now, all you need is a thirty day notice, given on the 1st of the month. Before you move out, clean and make sure the landlord is with you when she does the walk through. If you have a cleaning list from the landlord, follow it and check mark what is done.

Documentation is what you need. Dates, what was said and promised. Pictures or video are great also, if you need to take her court for your deposit.
