    Can the police drop the charge and let my husband out of jail?
    My husband and I have been married for 3 years now and I really love him. He's cheated on me before and the only person who CAN hurt me emotionally. His cheating on me, has caused me so much problems that I bottle them up inside and last night all these problems exploded. To make matters worst, we we're drinking alcohol and I got very wasted and had a 'black out' for a while, we started argueing, and physically fighting. I vividly remember the police arriving and the ambulance, and my husband had already left the house before the cops came. I gave the police the name of my husband and told him he had stabbed me where I was bleeding. Now that I"m sober and returned from the hospital, I feel very bad I told the police he had did it. See with all the problems I have and feeling like he dosn't "love me", and being wasted like I was, I cut myself with a piece of glass. Now my husband is in jail for Aggrevated Assault with a deadly weapon and his court date is not until Febraury 11th. At the moment, I was mad at my husband and was drunk when I told the police that it was my husband :(... what can I do now? They will be sending him to Mexico because he isn't a citizen of the US. I am a citizen and have already started the process on his paper work to change his status. Can I get them to drop the charge and MAYBE let him out? Im here in Phoenix, AZ, lonely, lost, and regretful, and need your advice.

    You certainly have quite a messy situation. I don't know what will happen to your husband. If you are married I'm not sure why he would be sent back to Mexico if you are a citizen. I don't know the laws. You can tell the truth about the incident which would certainly help out your husband, but you might find yourself charged with something such as false report. The drinking might be considered a factor, but I am not aware of what consequences will be. I think you need to do the honest thing regardless as well as seeking both counseling and assistance with your addictions.

    I am currently taking random drug tests, which helps me say "no" to drugs, and tomorrow is my first counsling session for alcohol. Do you know the consequences of being charged with a False Report? Jail time?

    I doubt they will drop the charges, at best they will reduce the charges to domestic violence assult, ( and leave the weapons charge out)
    But remember on domestic charges they are used to the person feeling bad the next day and wanting to drop the charges. So normally they will not just drop the charges.

    But most important, the police have nothing to do with it at this point and time, the DA is in charge now, so you will need to go into the DA and talk to them,

    You use alcohol and then blame that for your pitiful condition. I highly doubt the police will drop the charges. They see that often enough - the partner files and then recants when sober. What is going to happen the next time you two get drunk together?

    You need to spend some time in rehab as I doubt this is your first time being that drunk. You have problems with alcohol, anger, and lying (to the police, to yourself, etc.). I do hope you get the true help you need.

    The consequences can vary for the false report charge... from fine, to probation... up to the judge... might help to explain your case and that you are seeking treatment, that you were not in control as in "under the influence" when the charges were filed... Good Luck with the treatment and with the legal system... I hope it works to benefit you.

    Cops and Judges are used to the wife coming in after the fact and saying that they made the charges up to get the husband in trouble. Anytime there is any violence involved domestically the court will take everything into consideration and rule accordingly. The fact you said he stabbed you and the police could see a wound they are going to take your word that he did this to you regardless of the fact you were drunk or sober. You cannot get them to just "drop" the charges as someone was injured. Sorry. There have been too many women ahead of you who pulled this stunt of wanting the charges to be dropped whether the man did or did not do the violence.
