    I'm moving to a new state due to my husband getting a job there. I signed a new lease two months ago for another year in our current apartment. I new lease starts feb 1 2008. How can I get out of this lease that has not already started?

    You need to check the early termination rights in the lease.

    Most do have a provision for Employment Transfers, hopefully yours does too.

    Actually most leases don't have provision for employment transfers. You have a few options though:

    1) talk to the landlord and see if they will let you out.
    2) negotiate a buy out with the landlord (generally 2 months rent)
    3) sublet
    4) find a replacement tenant
    5) break the lease and let him sue you Unless you are in Fl, the landlord has to make a good faith effort to rent the unit. And once rented, your responsibility ends.
