    Tax refund for stay lesser than 180 days in US
    HI,

    I came in US on 7july 2007. Which means that I have not completed the 180 days in US for the tax calculation of 2007. I am still in US.

    I am on a L1 visa and my company is withhelding all the federal taxes etc. from my monthly salary.

    I wanted to know... will I get full tax refund or is there any disadvantage/loss of being in US for less than 180 days for last tax year (2007)

    Need to know from WHICH country you come.

    Odds are that you ARE liable for income taxes, though you probably file as a non-resident alien (Form 1040NR) for 2007.

    Thanks a lot for the response.

    I am from India. Is there any way like asking for a extension period and file my tax return in may or later so that I complete my 183 days and get more refund?

    Okay, you were in the U.S. for less than 183 days for 2007.

    So you meet one of three requirements to be completely tax exempt.

    Two questions:

    - Were you paid by a U.S. company or by your company in Indian in Indian rupees?

    - Or were you paid by a U.S. affliate of your Indian company?
