File a motion in your county Family Court. Depending on how long the mother's been missing, the judge will probably initially issue a temporary custody order. Some action will have to be taken to attempt to locate the mother's whereabouts and the judge will probably instruct you on how to proceed. If a good faith attempt is made to locate her but without success then the custody order can be made permanent. If she is located then the custody battle will begin in earnest. Also, where is the father in all of this? Are his whereabouts unknown as well? The judge will want to know that. If his whereabouts are known and he wants custody then his rights will trump yours.
