    Child support without rights
    If I live in New York, and I have given up rights to my children do I still have to pay child support? I gave up rights and custody completely of my children 14 months ago and they are making me pay child support, is that possible?

    Yes it is. My first question is how did you give up rights? Did you go to Family Court and have a judge affirm your relinquishment of rights? Unless you did, then you did not relinquish rights.

    Even if a judge did affirm your relinquishment, that doesn't relieve you of your responsibility towards YOUR children.

    Yes, we tell people that here every day ( and I mean everyday) Rights and Obligations are to separate things, your rights are to see the child, have a say in the child lifes and so on. Men ( well normaly the man, but really the non custody parent) has some false ID that there is not a legal obigation to pay child support.

    Not only can the other parent hold you liable for the child support, if they were on any government assistance, the state can even come after you for repayment even if you give up all of your rights.

    It would appear first you signed some papers without talking to an attorney. But as scott said, a lot of Judges will not allow a person to give up their rights, so beyond signing something the mother gave you, did you actually go to court and have it ruled on by a judge.

    I am the mother. I did go to a family court and have my rights relinquished and my children were also adopted out 14 months ago. I was not sure if I was supposed to pay the childsupport still since they were adopted and I had no rights to them.

    In case of adoption, the adoptive parents assume full responsibility for the children. So, no, you shouldn't have to pay support anymore. However, there may have been some agreement as part of the adoption that may have required continued support. Ask the agency that is deducting payments why they are still doing so.
