    Hi Atlanta Tax Expert
    I have a question about filing taxes,I came to us in feb 2007 on h1b.my wife and one kid
    Are back home in india and they are arriving us on feb 1st2008.can I claim them as dependents for 2007?do I need to apply TIN before filing taxes?Please let me know how to claim them as dependents and if you could provide consultancy services please mail me to [email protected].

    Do I need to apply TIN before filing taxes? No.

    Agreed; you need to file jointly to claim the child as a dependent. Your wife is NOT your dependent; she is your co-filer.

    You submit Form W-7 for ITINs for wife and child WITH the tax return. You can try doing it at the local IRS office, but not all IRS offices can issue ITINs. Call first and ASK!
