    Tax Return
    I am a F1 student from India on OPT. My annual salary was fixed at $50K. I joined job in November and was paid $8333.34 in regular wages for November and December. The INS is $ 314, federal tax is $1317.54 and state tax is $ 389.14 (Virginia). The social and medicare taxes were also deducted $497.17 + $116.27.

    How ever I was told by filing form 843, I will get them back. Now I am filing taxes. I am single. No other sources of income.How much federal and state taxes refund will I get?

    Well, Your approximate Federal refund is $1642.

    Okay, the federal tax form is Form 1040NR-EZ. Not sure about Virginia.

    As for the Social Security and Medicare tax refund, Form 843 IS the correct form, but it is filed SEPARATE from the annual tax return. However, you NEED to ask the employer for these taxes back and, if he refuses, get it in writing.

    HOW OLD are you?

    If you are over the age of 24 at the end of 2007, you probably qualified for the Earned Income Credit.

    Only way I can think about you getting more back than what was withheld.

    For Earned Income Credit you must be citizen or resident alien all year.

    For FICA taxes you must ask your employer to return you the taxes. Send them email. Also make sure that in 2008, they don't hold FICA taxes.

    True about EIC for full-year resident alien only.

    Then I am stumped!
