    Can an a 21 year old sue in California to receive support?
    Hello My Name Is Elizabeth And On My 21st Birthday A Man Came Up To Me To Tell Me He Is My Biological Father.

    He Told Me He Waited Till I Turned 21 So I Could Not Sue Him For Child Support.thats Cold Hearted And I Would Like To Know If I Can Sue Him For Part Support? Or For Money That I Need Has An Adult.

    Are you a student?

    And, no, parents do not get ordered to support adult (over 21) children because they need money as adults.

    What does your mother say about all this? Why didn't she sue for support before you turned 21 - if you know.

    I am trying to enroll to community college right now. My mother didn't want to sue him so my fathers wouldn't find out.I just want him to pay for my school or something.I want to sue the biological father not my mom.

    Right, I understand but your mother went a lot of years without support which she could have collected and I just wondered why. She could have put it away if she didn't need it and used it now for your schooling.

    No, I don't think you can sue him for support but you could talk to your local Family Court and follow their advice. I would think he would want DNA to make certain you are his child.

    Is he in contact with you or was this a one time "hi."

    Probably not. Suing him for child support was your mother's place while she was raising you as a minor. If you weren't raised by your mother then whoever raised you should have sued him and your mother both for child support. But as an emancipated adult at the age of 21 it's not likely that you can collect any kind of child support from him after the fact.

    I think your mother should go find a Child Support Services Agency where you live and get information. As it is now they can still go back and collect Child Support from the biological father even though the child is over the age of 18. Child support stops at the age of 18 but if the father did not pay for child support from the beginning the mother can go back and collect some or all of it. Good Luck !

    What State are you in? The "father" did not refuse to pay support and now some unit is going to collect it - the mother never pursued it. And child support mostly definitely does NOT stop at 18 in all States.

    There isn't even any DNA testing to prove the alleged father is the father; that's why I wondered what the mother says about all of this.
