Can a spouse sign a lease on a rental without the consent of the other spouse?

    Hello rox:

Sure. He can sign anything he wants. Why don't you tell us what happened, and maybe we can help.

My husband is living in FL... I'm out of state. While he's living there we had agreed on what type of apartment would work... budget, etc. Now he's telling me he plans on leasing a condo that is out of our budget. If he signs this lease and can't pay the rent or breaks the lease (or in the case of divorce) will I be responsible for it as well? Even if my name isn't on the lease?

    Thanks again.

If your name is not on the lease you probably would not be responsible for it, especially in a breakup.

He should be held financially responsible as you did not sign the lease. You may have problems if you live in the condo with him, though.

    Hello again, roxann:

If Florida is a community property state, then it's my view that you can be held responsible for an agreement that he signed and you didn't.
