    Voluntarily Relinquishing Parental Rights
    I have a son who is 16 months old and his father has never really been apart of his life. I have lived in Illinois for the last year and his father lives in Arizona. He has never paid child support nor have I ever pursued him for it. His father is not a good person and I would rather him be out of our lives. I recently received an email from him stating that he sucks at life basically and would like to sign over his rights.
    A. How do I go about doing that (if it's even a good idea)
    B. Do I start pursuing him for child support or would it not get approved if he has signed over his rights?

    Please help :confused:

    You have to go to court to have any of his righs to be taken away,
    And the judge may not even allow it.

    What you need to do, is force the issue of his paying and get child support enforcement after him.

    That's exactly my concern is that he is stating this so he will feel like he is getting out of the child support issue, although I have never really addressed the issue.

    Do I file for Child Support and then once the order is place ask him to sign off on relinquishing parental rights?

    I also want to change my son's last name and get him off the birth certificate if possible. I just am anxious because he is finally saying he will give up after a 1 1/2 of being a jerk about it - but I don't want to screw it up!! :eek:

    I doubt you can have him removed from the birth certificate. He is the father and unless he really isn't the father then I don't see a court allowing that. Your child is entitled to seek him out some day regardless of how you feel about him. And if he doesn't relinquish his rights your stuck with him the rest of your lives so think carefully

    There are many many threads here all dealing with this issue. I strongly suggest you take the time to read some of them.

    Bottom line here is that the courts will rarely grant a TPR except where there is someone waiting to adopt or the parent represents a danger to the child. I don't see either in this case. So frankly I would forget about it. At this point it appears he is not exercising his rights so you don't really gain much. I'm sure he's afraid you will come after him for support and that's why he wants to get out. But, like its been said, its unlikely the courts will grant it.
