    Civi case pending
    One of my creditors decied to file suit and when their lawyer contacted me they told me that the debt is two years and when they filed suit they marked that the debt is 4 years. How can they mark the suit for 4 years and then tell me it is 2 years before. When you are served with a summons are you supposed to sign for it that you received it the process sever did not get singature from me he just gave me the paperwork.

    No process server does not have to get you to sign for it, ( at least in any state I have ever served papers before) and the fact they misstated the age of the debt will not effect the court case, and if it did, they would just have to refile and serve you over. The real issues is it a valid debt, have you tried to work a payment plan with them,
