    Question is in a charge off debt I am being sued for an amount it that legal

    Hello mac:

    When they use the term "charge off", they're giving the IRS a message regarding how they're going to report the loan on their taxes.
    They are NOT giving you a message. You still owe them and they can sue you.

    excon is completely correct, being "charged off"is an accounting term and bases the tax status of the payment due.

    This does not stop or change your liability in paying them. And yes they may still sue you for the money

    We have two accounts that they labeled as charge off and now another collection agency has gotten a lawyer and served us with a civil summons so make sure to settle the debet if possible
